Eightivity is a product developed by Elev8 Digital, a subsidiary of Activ8.asia, operating from No 11, Castle Lane, Colombo 04, Sri Lanka. By using eightivity.travel, you agree to these Terms and Conditions set out by Elev8 Digital as the responsible entity.
Eightivity (available at eightivity.travel) is a CRM and operations management platform purpose-built for the travel industry. It is a product developed and maintained by Elev8 Digital, a subsidiary of Activ8.asia, registered and operating out of No 11, Castle Lane, Colombo 04, Sri Lanka.
References to "we", "us", or "our" in these Terms refer to Elev8 Digital as the entity responsible for the Eightivity platform. References to "you" or "Client" refer to the travel business or individual accessing the Service.
By accessing or using the Eightivity platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you may not use the Service. These Terms apply to all users including travel agencies, tour operators, destination management companies, and other travel businesses who register for and use Eightivity.
Eightivity is a structured business solution built by Elev8 Digital specifically around how travel businesses actually operate. The Service includes tools for itinerary management, client relationship management, team collaboration, booking tracking, document generation, and other features as described on eightivity.travel.
Elev8 Digital reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
To access the Service, you must register for an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to: (a) immediately notify us of any unauthorized use of your account; (b) ensure you log out at the end of each session; (c) not share your credentials with any third party. Elev8 Digital will not be liable for any loss arising from your failure to comply with these obligations.
Access to Eightivity is provided on a subscription basis. Fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are exclusive of applicable taxes, which will be added where required by law.
Failure to pay subscription fees may result in suspension or termination of your account. Fees already paid are non-refundable except as expressly stated in our Refund Policy. Elev8 Digital reserves the right to change pricing with 30 days' prior written notice.
You retain full ownership of all data, content, and information you upload or transmit through the Service ("Client Data"). Elev8 Digital does not claim any intellectual property rights over your Client Data.
By using the Service, you grant Elev8 Digital a limited, non-exclusive license to use, store, and process your Client Data solely for the purpose of providing the Service. Our data practices are governed by our Privacy Policy, incorporated into these Terms by reference.
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe upon the intellectual property rights of any third party; (c) transmit harmful, offensive, or unlawful content; (d) attempt unauthorized access to any part of the Service; (e) send unsolicited commercial communications; or (f) interfere with the proper functioning of the platform.
Elev8 Digital reserves the right to suspend or terminate accounts found to be in violation of these provisions without prior notice.
The Eightivity platform, including its software, design, branding, and content (excluding Client Data), is owned by or licensed to Elev8 Digital and protected by applicable intellectual property laws. You may not copy, modify, distribute, or resell any part of the Service without our express written permission.
The Eightivity name, logo, and product identity are assets of Elev8 Digital. Elev8 Digital is a subsidiary of Activ8.asia.
Eightivity may integrate with or link to third-party services. These integrations are provided for convenience only and Elev8 Digital does not endorse or assume responsibility for third-party content, privacy policies, or practices. Your use of third-party services is subject to their own terms and conditions.
To the maximum extent permitted by applicable law, Elev8 Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Eightivity, including but not limited to loss of revenue, data, or business opportunity.
Elev8 Digital's total aggregate liability for any claims under these Terms shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.
Either party may terminate the agreement at any time. Upon termination, your access to the Service will immediately cease. Elev8 Digital will make your Client Data available for export for 30 days following termination, after which it may be permanently deleted.
Elev8 Digital may terminate your account immediately if you are found to be in material breach of these Terms, including non-payment or violations of the Acceptable Use policy.
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka.
Elev8 Digital reserves the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on eightivity.travel and, where appropriate, by email notification to your registered address. Continued use of the Service after such changes constitutes your acceptance.
